    Ex-guard acquitted of raping a bride on her wedding night

    A former hotel security guard charged with raping a guest in her room on her wedding night in January was acquitted Thursday by a 3rd District Court jury.

    The five-woman, three-man jury acquitted Derrick Brewer, 26, of rape and burglary charges, deliberating 1 1/2 hours on the third day of the trial. The Salt Lake woman who reported the Jan. 22 incident told the jury Tuesday how her wedding night devolved into a night of drinking, drugs and fighting with her new husband and finally ended with her being raped while still wearing her wedding dress.

    But defense witnesses told a different story, one of the woman telling the Little America hotel employees that evicted the groom from their room how attractive they are and inviting them to visit her when they got off work.

    One man testified the woman grabbed his buttocks and hung onto his arm while he waited with her as the hotel manager and Brewer asked her husband to leave.

    A friend of the woman, who was her maid of honor at the wedding, testified the woman called her at home about an hour after the incident to tell her about it and said she was reluctant to report it to police because the guard was "kind of cute."

    Prosecutor Jim Cope and defense attorney Paul Quinlan agreed that Brewer and the woman had sex but disagreed on whether she consented.

    The woman said she was asleep when Brewer came into her room around 6 a.m. and shook her awake. She was frightened, she said, because she knew he was a security guard for the hotel.

    After talking to her for awhile, the woman testified, Brewer took off her underwear and raped her. She told the jury she didn't tell Brewer to stop or physically try to stop him, deciding it was better not to resist.

    Brewer did not testify, but Quin-lan told the jury in his closing statement that Brewer had legitimate business in her room. He needed to talk to the woman to get information for an incident report, and the hotel had received a phone call from her family that the woman may be suicidal, Quinlan said.

    And, Quinlan admitted, Brewer thought there might be the possibility of sex with the woman.

    Under questioning, Brewer told police investigating the incident that he first knocked on the woman's door but got no answer. Brewer and the manager had checked on the woman earlier, using pass keys to enter her room when she didn't answer the door.

    He found her asleep, Brewer told police, and shook her awake to talk to her. The woman first went to the bathroom, then came out and began undressing, he told police, which led to them having sex.

    Cope admitted the woman's testimony was hazy, noting her use of alcohol and drugs that night. Although she may have "holes in her head," Cope told the jury at one point, she recounted the story as she recalls it.

    Brewer's action was "boneheaded, stupid, a mistake, immoral and dumb," Quinn told the jury and will haunt him for the rest of his life. Brewer was fired from his hotel security job the same day, and his hoped-for career in law enforcement will never happen, Quinlan told the jury.

    Quinlan said after the verdict that Brewer is"incredibly happy. It's a huge victory for Derrick, to clear him. But his life is still ruined. The stigma of being falsely accused of being a rapist will follow him all his life."

    The prosecutor then asked her to relate to the jury how 'painful' her rape had been since she had been a virgin and she tried to hold back tears as she went into detail of her rape.

    She said that her assailant seemed 'quite large' to her and his initial entry was painful at first not only because of her hymen being ruptured but also from his size since he was stretching her so far out and then insisted on going so deep.

    The defense interrupted her testimony at that point and asked her how her 'rapist' seemed to be 'quite large' to her since she had been a virgin and how would she know the difference?

    She said that though she had never had physical sex with her husband before or since her marriage up to that point that she had fondled and seen her new husband's penis in 'make out sessions' over the past months before their marriage and that her rapist was much larger.

    She was interrupted by the defense and asked whether she had actually seen the defendant's penis prior to his placing it into her and she admitted that she had both seen and touched it.

    At what time was this, she was asked, and she said, while they were standing together.

    So you were aware of his large size compared to your husband's penis in advance, is that right, she was asked, and she admitted that she was, but had felt 'intimidated.'

    The defense at this point, perhaps trying to bring back to the jury her thoughts on how important her chastity had been to her previously, asked her again about her saving herself for her groom.

    While crying softly, she said that she had been proud to have been able to resist 'her urges' during those 'long make out sessions' and had managed to preserve her chastity for her husband to take on the wedding night.

    How did you resist your urges she was asked by the defense, and she admitted that she had masturbated her husband's penis all the way to orgasm for him a few times, and had steadfastly refused to allow him to 'feel under her underwear.'

    The prosecution under questioning had her say that she would certainly have no reason to be giving her virginity to some security guard after having saved herself so faithfully for her husband.

    The prosecution had the court stenographer read back the previous testimony she had given about 'her rape starting to feel good after a while,' and then, after it had been read to the jury, went on to ask the woman to explain to the jury how it had felt good to her if she was in fact, being raped.

    She said that the reason she had appeared to be enjoying sex with the guard was because she was still partially under the influence of drugs and that she had 'no control' over her body's physical reaction to his sex organ.

    Thus, she claimed, it might have appeared to him after a while that she was enjoying it, but she said it was only in her body and not her mind.

    Did you try to think of other things during your rape, she was asked, or try in some way to ignore what was happening?

    She stopped her testimony at that time and though the prosecution objected, the judge ordered her to complete the sentence, and she went on to say that she wanted to 'get even with her husband, but wasn't thinking clearly because of the drugs.

    You wanted to get even and that's why you allowed the defendant to enter you without wearing a rubber because of the possibility that you might become pregnant by another man, is that the reason?

    It was a thought that occurred to me, but only for a second, she said. I certainly did not want to become pregnant by the defendant.

    So why didn't you tell him about the rubbers? Was it also because you knew or had heard that sex feels better without a rubber?

    She responded that she had no way of knowing how it would feel since she had never had sex either way.

    But you have heard that, haven't you, that sex is better without a rubber, and she admitted that she had heard that before, yes.

    Fortunately, she said, that though her rapist 'did it twice, meaning he reached orgasm in her twice, she luckily did not become pregnant.

    The prosecution tried at this point to say that the guard had kept going and raped her two times without asking but the defense, under cross-examination, got the bride to admit that they had stopped between the two acts.

    Then, she admitted, she had made out with the guard and played with his penis prior to his entering her a second time.

    When asked why she had done this, she said that she felt intimidated and just wanted to 'keep him happy and allow him a second orgasm.'

    Because she had, by her testimony entered the subject of orgasms into the court records, she was asked by the defense if she too had reached orgasm.

    By felt for you, what do you mean specifically, he was asked, and he replied that she had felt around for his penis, squealed for joy when she found it to be erect, and that she had gone ahead and pulled it out.

    He was asked by the police if he had been aware that the bride was still a virgin and answered that he had not known at first but as soon as he had partway entered her he had known because he had felt her tear.
